: This is an application for bail pending appeal. The applicant was convicted in November 2017 on one count of stock theft in contravention of s114 2(a)(i) of the Criminal Law (Codification and Reform Act) Chapter 9:23. The court did not find any special circumstances, it then imposed the mandatory sentence of 9 years imprisonment.
The applicant filed an appeal against conviction in 2022 after being granted leave by this court to do so under HC7/22. More

He was sentenced to 14 years imprisonment of which 2 years were suspended for 5 years on related conditions. One year imprisonment was suspended on condition of restitution of the sum of US$3859.00. The facts are that, on the 29th of June 2022, at Victory farm Mhangura, it is alleged that the accused in the company of three or so others, vandalized a 200KVA transformer after tying and incapacitating the security guard on the premises. They made away with the copper windings from the vandalized transformer after tying and incapacitating the security guard. The applicants are facing one count of robbery. The allegations are that on the 24th of April 2022 the applicants in the company of seven other accomplices still at large hired a silver Nissan caravan registration number ADC 7476 from one Simbarashe Jabangwe. They were armed with an unknown type of a firearm. They wore camouflage. They proceeded toa mine known as Golden Etolpacks, ARDA Endeavour Mhangura where they threatened the security guards, tied their hands and legs and took their cellphones. More
This is an application for bail pending appeal. The applicants appeared before a Regional Magistrate sitting at Karoi on three counts of robbery in contravention of s126 (1) (a) of the Criminal Law (Codification and Reform) Act Chapter 9:23. They pleaded not guilty but were all convicted and each was sentenced to 12 years imprisonment of which 4 years imprisonment were suspended on condition of good behavior.
