The accused is charged with murder as defined in section 47 (1) of the Criminal Law (Codification and Reform) Act [Chapter 9:23], it being alleged that on 8 January 2018 and at village 3, Beconkop Farm, Shurugwi he unlawfully caused the death of Batsirai Shava, by striking her with an axe once on the head and once below the left jaw, intending to kill her or realizing the real risk of his conduct causing death and continued to engage in that conduct nonetheless. The trial court erroneously caused the prosecution of a 12 year old juvenile without the Prosecutor General’s authority in terms of section 231 of the Criminal Law [Codification and Reform] Act [Chapter 9:23]. The section provides:
“231. Prosecutor-General to authorize prosecutions of children under fourteen years.
No proceedings in respect of any crime shall be instituted or continued against any person who is under the age of fourteen years, other than proceedings for the purposes of remand, without the authority of the Prosecutor-General.” More

The accused person faces a charge of murder it being alleged that on the 9th of May 2016 and at house number 692/5 Mbizo, Kwekwe, the accused person unlawfully caused the death of Thelma Mashiri by striking her with an electric cable many times all over the body. The accused person pleaded not guilty to murder but tendered a limited plea to culpable homicide.
