The matter started off as a murder trial. At the close of State case, parties conferred and agreed that the accused persons’ plea to culpable homicide be accepted. A statement of agreed facts outlining common cause aspects was compiled and presented before the court. Having established the genuiness of the plea of guilty to culpable homicide we retained a verdict of guilty to culpable homicide. The accused, aged 20 years is facing a charge of Murder as defined in S 47(1)(a) or (b) of the Criminal Law (Codification and Reform) Act [Chapter 9:23]. The accused in this case pleaded not guilty to a charge of murder proffered by the State. On 15 September 2021 an application was filed by The Trustees Manicaland Commercial Federation Trust wherein it sought an order declaring;
a. First respondent’s 2020 supplementary budget process and consequent budget to be flawed and in contravention of s219 of the Urban Councils Act;
b. First respondent’s budget process 2021 budget process and consequent budget to be flawed and in contravention of s219 of the Urban Councils Act;
c. The consequent increases from those budget processes and budgets to be unaffordable to ratepayers given the Covid 19 induced economic turmoil;
